अधिसूचना - 

क्रमांक आरटी ई-२०१९/प्र.क्र.२५/एस.डी. १. बालकांचा मोफत व सक्तीच्या शिक्षणाचा हक्क कायदा २००९ (२००९ या ३५) च्या कलम ३८ मधील उप कलम (१) आणि (२) नुसार प्रदान करण्यात आलेल्या प्राधिकारास अनुसरून आणि वासंदर्भात इतर प्रदत्त शक्तीनुसार महाराष्ट्र शासन याद्वारे महाराष्ट्र बालकांचा मोफत व सक्तीच्या शिक्षणाचा हक्क नियम, २०११ सुधारित करण्यासाठी खालील नियम तयार करीत आहे ते म्हणजे

१. या नियमांस महाराष्ट्र बालकांचा मोफत व सक्तीच्या शिक्षणाचा हक्क (सुधारित) नियम, २०२४ असे म्हणावे. 

२. महाराष्ट्र बालकांचा मोफत व सक्तीच्या शिक्षणाचा हक्क नियम, २०११ मधील नियम ४ (यापुढे सदर नियम असा उल्लेख

करण्यात येईल. उप नियम (५), नंतर खालील शर्तीचा समावेश कराया, जसे की 

"परंतु असे की, महाराष्ट्र बालकांचा मोफत व सक्तीच्या शिक्षणाचा हक्क (वंचित व दुर्बल गटातील बालकांचे इयत्ता पहिली किंवा पूर्व प्राथमिक वर्ग या स्तरावर कमीत कमी २५ टक्के प्रवेश करण्याची पद्धत) नियम, २०१३ नुसार वंचित व दुर्बल घटकातील २५ टक्के प्रवेशाकरीता ज्या खाजगी विना अनुदानित शाळेच्या एक किलोमीटर परिसरात शासकीय शाळा व अनुदानित शाळा आहेत अशी शाळा स्थानिक प्राधिकरणाकडून निवडण्यात येणार नाही.

३. नियम ८ च्या उप नियम (२), नंतर खालील शतींचा समावेश करावा, जसे की-

"परंतु असे की, नियम ४ च्या उप नियम (५) खाली निवडण्यात आलेली कोणतीही खाजगी विना अनुदानित शाळा कलम १२ च्या उप कलम २ नुसार प्रतिपूर्तीकरिता पात्र ठरणार नाही."

In pursuance of the authority conferred by sub-sections (1) and (2) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009) and in accordance with other powers conferred by the Government of Maharashtra, the Maharashtra Right of Children to Free and Compulsory Education Rules, 2011 Making the following rule to modify that is

 1. These rules may be called the Maharashtra Right of Children to Free and Compulsory Education (Amendment) Rules, 2024.

 2. Rule 4 of the Maharashtra Right of Children to Free and Compulsory Education Rules, 2011 (hereinafter referred to as the said Rules).

 will be done. Sub-rule (5), then inserted the following proviso, viz

 "But provided that under the Maharashtra Right to Free and Compulsory Education (at least 25 per cent admission of children belonging to deprived and weaker sections at the level of Class I or Pre-Primary) Rules, 2013 for admission of 25 per cent from disadvantaged and weaker sections to private unaided schools The local authority will not select schools where there are government schools and aided schools within one kilometer area.

 3. Sub-rule (2) of rule 8, then the following clauses shall be inserted, viz.-

 "Provided that, no private unaided school selected under sub-rule (5) of rule 4 shall be eligible for reimbursement under sub-section 2 of section 12."
